For the first time the Fair Work Ombudsman has commenced legal action against an accounting firm for it’s alleged involvement in the underpayment of 2 staff members.
EZY Accounting 123 provided payroll services for a client of theirs, Blue Impressions Pty Ltd.
The Fair Work Ombudsman has alleged that two of Blue Impressions casual employees were underpaid a total of $9,549.00. The employees were paid a flat hourly rate of $16.50 per hour which was below the minimum base rate of pay. In addition, the employees were not paid other entitlements under the relevant award, the Fast Food Industry Award.
The Fair Work Ombudsman has alleged that EZY Accounting 123 knew that the rates of pay were well below the lawful minimum. EZY Accounting 123 faces penalties of up to $51,000.00 per contravention.
Under section 550 of the Fair Work Act 2009, a third party can be subject to penalties if it is ‘involved in’ a contravention of the Act.
